The standard in determining child custody, placement & visitation is to look at what is in the best interests of the child. The court will consider the factors set forth in relevant case law, specifically, Pettinato v. Pettinato, 582 A.2d 909 (1990) to determine what is in the best interest of the child. Some of these factors include the wishes of the child’s parents, the child’s preference if the child is of sufficient intelligence and understanding to express a preference and the stability of the child’s home environment, etc., to name a few. Attorney Finkelman can advise you of all of the relevant factors considered by the court and advise you as to how they would be applied to your children.
